About Fred Silberberg
One of Southern California's most experienced family law litigators, Fred Silberberg has specialized in the field for over thirty years. Fred's practice eventually expanded to the handling of parentage law related disputes.
Fred was a trailblazer in this area, successfully representing actor Jason Patric and others who sought to legalize the relationship they had with children conceived through IVF. The Patric case was one of first impression, resulting in a change in California parentage law which established Patric as the legal father of his son. Fred's successful prosecution of this case resulted in two published decisions establishing new law in the parentage area. In Jason P. v. Danielle S. (2014) 226 Cal.App.4th 167 the court granted Patric the right to claim parentage if he could meet certain established criteria available to non-sperm donor fathers. In Jason P. v. Danielle S, 9 Cal. App. 5 1000 (2017), the court found that Patric did meet the criteria and held hiim to be the legal father of his son.
Fred successfully represented Sofia Vergara in various lawsuits over control of embryos created with a former romantic partner who attempted in lawsuits filed in both California and Louisiana to take control over the embryos over her objection. In four separate cases in two states involving both trial and appellate court work, Fred obtained dismissals of the cases initiated by her former partner and successfully prosecuted a case initiated against that partner which resulted in a permanent injunction preventing him from taking any further action to disturb the parties agreement requiring joint consent to use the embryos.
Fred has represented numerous people in need of appropriate legal documentation to create a family including sperm donor agreements, ova agreements, parentage agreements and surrogacy agreements.
After nearly forty years in family law, Fred now devotes his time to assisting parties needing legal services to start their families using fertility procedures. He provides a personalized approach to every client.
A recognized leader in the field, Fred served on the Los Angeles Superior Court Family Law Mediation Panel for over 15 years, and is also a prolific writer and media commentator. For many years, Fred was the author of the op-ed Family Law Forum Column in the Daily Journal. Fred has appeared on numerous television programs and been interviewed and quoted in the press on these topics. Fred's appearances have included The Today Show, Good Morning America, The Katie Couric Show, The Los Angeles Times, USA Today, People Magazine, KCAL Channel 9, KABC Radio, Entertainment Tonight, and E! Entertainment Television.
